13. Legal basis for processing
Art. 6 I lit. a DS-GVO serves as the legal basis for our company for processing operations in which we obtain consent for a specific processing purpose. If the processing of personal data is necessary for the performance of a contract to which the data subject is a party, as is the case, for example, with processing operations that are necessary for the delivery of goods or the provision of another service or consideration, the processing is based on Article 6 I lit. b DS-GVO. The same applies to processing operations that are necessary for the implementation of pre-contractual measures, for example in the case of enquiries about our products or services. If our company is subject to a legal obligation by which the processing of personal data becomes necessary, such as for the fulfilment of tax obligations, the processing is based on Art. 6 I lit. c DS-GVO. In rare cases, the processing of personal data might become necessary in order to protect the vital interests of the data subject or another natural person. This would be the case, for example, if a visitor were to be injured on our premises and as a result his or her name, age, health insurance details or other vital information had to be passed on to a doctor, hospital or other third party. Then the processing would be based on Art. 6 I lit. d DS-GVO. Finally, processing operations could be based on Art. 6 I lit. f DS-GVO. Processing operations which are not covered by any of the aforementioned legal bases are based on this legal basis if the processing is necessary to protect a legitimate interest of our company or a third party, provided that the interests, fundamental rights and freedoms of the data subject are not overridden. Such processing operations are permitted to us in particular because they were specifically mentioned by the European legislator. In this respect, it took the view that a legitimate interest could be assumed if the data subject is a customer of the controller (recital 47, sentence 2 of the GDPR).
Processing pursued by the controller or a third party
Where the processing of personal data is based on Article 6 I lit. f of the GDPR, our legitimate interest is the conduct of our business for the benefit of the welfare of all our employees and our shareholders.

We embed YouTube videos on some of our websites. The operator of the corresponding plugins is YouTube, LLC, 901 Cherry Ave, San Bruno, CA 94066, USA. When you visit a page with the YouTube plugin, a connection to YouTube servers is established. This tells Youtube which pages you are visiting. If you are logged into your YouTube account, YouTube can assign your surfing behaviour to you personally. You can prevent this by logging out of your Youtube account first.
If a Youtube video is started, the provider uses cookies that collect information about user behaviour.
If you have deactivated the saving of cookies for the Google Ad programme, you will not have to expect any such cookies when watching Youtube videos. 19 Google Adwords Conversion Tracking
We use “Google Conversion Tracking” for the statistical collection of marketing campaigns. This service is provided by Google Ireland Limited (“Google”), a company incorporated and operated under the laws of Ireland (registration number: 368047) with its registered office at Gordon House, Barrow Street, Dublin 4, Ireland.
Google Adwords sets a cookie (see 2.2) on your computer if you have accessed our website via a Google advertisement. These cookies lose their validity after 30 days and are not used for personal identification. If the user visits certain pages of the Adwords customer’s website and the cookie has not yet expired, Google and the customer can recognise that the user clicked on the ad and was redirected to this page. Each Adwords customer receives a different cookie. Cookies can therefore not be tracked via the websites of Adwords customers. The information obtained using the conversion cookie is used to create conversion statistics for Adwords customers who have opted for conversion tracking. The Adwords customers learn the total number of users who clicked on their ad and were redirected to a page tagged with a conversion tracking tag. However, they do not receive any information with which users can be personally identified.
Google Conversion Tracking is used for the purposes of economic optimisation, the needs-based design of our website and the correct billing of advertising campaigns placed by us. This constitutes a legitimate interest within the meaning of Art. 6 para. 1 lit. f DSGVO.

21. Facebook Ads – Custom Audience
We use the “Custom Audiences” remarketing feature of Facebook Inc, 1601 S. California Ave, Palo Alto, CA 94304, USA (“Facebook”). With Custom Audiences, we can target the users of our website with advertising by displaying personalised and interest-related Facebook ads (https://de-de.facebook.com/business/products/ads) when they visit the Facebook social network.
We use Facebook Custom Audiences in the “Facebook Custom Audiences from Website” variant (Facebook Pixel). In this case, an invisible pixel is integrated on our website. When a potential customer looks at certain products on our website, puts them in the shopping cart and possibly cancels the order, this invisible pixel forwards the data to Facebook. The next time the potential customer logs on to Facebook, he or she will receive targeted advertising for the product that he or she had previously viewed, but possibly not purchased, due to the integration of the pixel.
This personal data is processed for the purpose of optimising our offers and individualised advertising. This is also in our legitimate interests, which is why the processing is permissible under Art. 6 (1) f DSGVO.
